Terms of Use & Enrollment Agreement

By enrolling in any course, training, certification, or program through SheCode Academy offered by Windtuition Wellness INC. (“Company,” “we,” “us,” or “our”), including via the Thinkific platform, you (“Student,” “Participant,” or “you”) agree to the following Terms of Use (“Terms”). These Terms apply to all students, regardless of payment method or program format.

If you do not agree to these Terms, do not enroll or participate.

1. Program Purpose & Educational Disclaimer

SheCode Academy provides educational and experiential content related to breathwork, embodiment, mindfulness, and personal development.

You acknowledge and agree that:

• The program is educational in nature

• It is not medical, psychological, psychiatric, or therapeutic treatment

• No diagnosis, treatment, or medical advice is provided

• Participation does not establish a therapist-client or healthcare relationship

You are solely responsible for your physical, emotional, mental, and energetic well-being during and after participation.

2. Breathwork & Somatic Practice Disclaimer

Breathwork and somatic practices may involve physical, emotional, or psychological intensity.

By enrolling, you acknowledge that:

• You are participating voluntarily

• You understand that breathwork may surface strong sensations or emotions

• You accept full responsibility for monitoring your limits

• You will stop any practice that feels unsafe or overwhelming

• You are responsible for consulting a qualified medical or mental health professional if you have any condition that could be impacted by breathwork (including, but not limited to: cardiovascular issues, respiratory conditions, pregnancy, epilepsy, severe anxiety, PTSD, or other medical or psychological concerns)

Participation is at your own risk.

3. Assumption of Risk & Release of Liability

To the fullest extent permitted by law, you:

• Assume all risks associated with participation

• Release and hold harmless SheCode Academy, its founders, facilitators, contractors, employees, affiliates, and partners from any claims, injuries, losses, or damages arising from participation

• Agree not to bring claims related to physical injury, emotional distress, or psychological response resulting from participation

This applies to all content, including videos, live sessions, recordings, assignments, and community spaces.

4. Non-Refundable Policy (All Enrollments)

All purchases are final.

You understand and agree that:

• All payments are non-refundable

• No refunds, credits, or partial reimbursements will be issued for:

  • Non-attendance

  • Partial participation

  • Scheduling conflicts

  • Personal circumstances

  • Emotional responses

  • Medical or psychological reasons

  • Dissatisfaction with content

  • Failure to complete the program

This applies to one-time payments and payment plans.

5. Payment Plans & Financial Commitment

If enrolling via a payment plan:

• You are committing to the full tuition amount

• Payment plans are not subscriptions

• You authorize recurring charges to your selected payment method

• Missed or failed payments may result in temporary suspension of access until resolved

• You remain responsible for the full balance even if access is suspended or participation stops

Failure to complete payments may result in revoked access and collection efforts.

6. Non-Transferable Enrollment

Enrollment is non-transferable.

You may not:

• Share login credentials

• Gift, sell, assign, or transfer access

• Allow another person to use your account

• Use materials for another person’s benefit

Any violation may result in immediate termination without refund.

7. Intellectual Property & Content Use

All course materials — including videos, audio, written content, frameworks, exercises, recordings, curriculum structure, and branding — are the exclusive intellectual property of SheCode Academy and Windtuition Wellness INC.

You may:

• Use materials for personal educational purposes only

You may not:

• Copy, reproduce, distribute, or record content

• Share materials publicly or privately

• Use content to create competing or derivative programs

• Teach, train, certify, or commercially apply materials without written permission (unless explicitly authorized as part of certification terms)

Unauthorized use may result in legal action.

8. Certification Disclaimer (If Applicable)

Completion of a certification program:

• Does not guarantee professional success, income, or employment

• Does not replace licensing, insurance, or legal requirements in your jurisdiction

• Does not authorize you to practice beyond your scope of training or local laws

You are responsible for understanding and complying with all applicable regulations.

9. Community Conduct & Confidentiality

Participants agree to:

• Maintain confidentiality of shared experiences

• Respect the privacy and boundaries of others

• Engage respectfully in all community spaces

Harassment, harmful behavior, unethical conduct, or violations of confidentiality may result in removal from the program without refund.

10. Termination of Access

We reserve the right to suspend or terminate access if you:

• Violate these Terms

• Engage in harmful or unethical behavior

• Share content without permission

• Fail to meet payment obligations

Termination does not release you from financial responsibility.

11. Chargebacks & Disputes

You agree not to initiate chargebacks or payment disputes.

Unauthorized chargebacks may result in:

• Immediate revocation of access

• Collection efforts

• Legal action if necessary

12. No Guarantees

We make no guarantees regarding:

• Outcomes

• Healing

• Emotional breakthroughs

• Certification results

• Income or career advancement

Results vary and depend on individual factors.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

14. Agreement & Acceptance

By enrolling in any SheCode Academy program, you confirm that:

• You have read and understood these Terms

• You agree to be legally bound by them

• You accept full responsibility for your participation, finances, and well-being
